Washington Consumer Health Data Privacy Policy

This Washington Consumer Health Data Privacy Policy (“Health Privacy Policy”) is provided pursuant to the Washington My Health My Data Act and supplements DwellSafe’s Terms of Use and Privacy Policy. This Health Privacy Policy only applies to our collection of Consumer Health Data (defined below) of Washington State residents.

Collection of Consumer Health Data

“Consumer Health Data” means personal information that is linked or reasonably linkable to a consumer and that identifies the consumer's past, present, or future physical or mental health status. Consumer Health Data does not include information that is publicly available, de-identified, or aggregated. What Consumer Health Data we collect may differ depending on your relationship with us.

Categories of Consumer Health Data We Collect

The Consumer Health Data we collect may include the following categories of data, to the extent you provide or an authorized third party on your behalf (such as Provider) provides this information to us in connection with our Services:

• Individual health conditions, treatment, diseases, or diagnosis;
• Medical interventions;
• Health-related surgeries or procedures;
• Use or purchase of prescribed medication;
• Bodily functions, vital signs, symptoms, or measurements of your Consumer Health Data;
• Diagnoses or diagnostic testing, treatment, or medication;

Categories of Sources of Consumer Health Data

We collect Consumer Health Data directly from you or an authorized third party on your behalf (such as a Provider) in connection with our Services.

Our Purposes for Collecting and Using Consumer Health Data

We collect, use, disclose, or otherwise process your Consumer Health Data as necessary to provide our Services to you (specifically, to assess your risk of falling within a particular premises and to recommend related accommodations to such premises) or to correspond with you in connection with our Services. We may also process your Consumer Health Data as described in the Other Permitted Purposes for Processing Personal Data section of our Privacy Policy.  

We do not engage in geofencing activities of in-person health care facilities for any purpose.

How We Disclose Your Consumer Health Data

We disclose your Consumer Health Data as reasonably necessary to certain third parties, which may include:

• Service Vendors. That help us process your Consumer Health Data, including:

• Hosting, technology and communication providers.
• Analytics providers for web traffic or usage of the site.
• Security and fraud prevention consultants.
• Support and customer service vendors.

• Providers.  These parties may include:

• Health Care Providers.
• Home accessibility and home modification professionals.
• Third parties that you have a relationship with.
• Third parties that access our Services on your behalf.

• Parties You Authorize, Access or Authenticate

• Third parties you consent to receive ancillary services from.
• Third parties you access through the services.
• Social media services.

Washington Consumer Health Data Rights

If you are a Washington resident, you have rights set forth in this section. Please note that your rights may be subject to certain conditions and exceptions under applicable law.

• Access: You have the right to request confirmation of or access to the Consumer Health Data that we process about you, including a list of all third parties and affiliates with whom we have disclosed your Consumer Health Data and their contact information.
• Deletion: You have the right to request that we delete the Consumer Health Data that we have collected about you.
• Withdraw Consent: You have the right to withdraw consent from us collecting and disclosing your Consumer Health Data.
• Appeal: If we refuse to take action on your request within a reasonable period of time after receiving your request in accordance, you may appeal our decision. If we deny your appeal, you have the right to contact the Washington Attorney General at www.atg.wa.gov/file-complaint.

To exercise your rights, you must send us a request that (1) provides sufficient information to allow us to verify that you are the person about whom we have collected Personal Data (such as your login credentials, name and/or address, as applicable), and (2) describes your request in sufficient detail to allow us to understand, evaluate and respond to it. Each request that meets both of these criteria will be considered a “Valid Request.” We may not respond to requests that do not meet these criteria.
